The above named hereby rents a
cellular telephone from Cellular
Telephone Rentals (CTR), a
division of Inversiones Italo
Enca S.A. - Cedula Juridica:
3-101-391995 – subject to the
terms and conditions below:
Terms and Conditions: RENTAL &
USAGE CHARGES (All taxes are
included): There is no charge to
make or receive calls within
Costa Rica. There is no charge
to receive International calls
paid by the calling party.
Rental: $9.95USD/day.
International: $1.25USD/min.
(Calls made to another country.)
PAYMENT OF CHARGES: Rental
charges are payable in advance.
If rental charges are paid by
credit card, Renter authorizes
CTR to charge this amount to the
credit card. Should the Renter
retain the cellular telephone
for more than the number of
prepaid rental days, Renter will
immediately pay to CTR
$9.95USD/day for each unpaid
day. Renter agrees to pay the
total rental and usage charges,
less prepayment(s) upon return
of the cellular telephone or, if
the cellular telephone is not
returned, upon demand by CTR. I,
the Renter, authorize the charge
to my credit/debit card and/or
deposit(s) an amount equal to
the difference between the total
charges and the amount I have
paid.
GUARANTEE AND/OR DEPOSIT(S): The
Renter may guarantee return of
the Equipment and/or payment for
International Calls with a
credit card or cash. If
guaranteed by credit card,
Renter authorizes CTR to reserve
the deposit(s) amount(s) shown
against the credit card.. If the
Renter’s charges for
International minutes exceeds
the amount of the deposit(s),
Renter authorizes CTR to reserve
an additional amount against the
credit card or collect an
additional deposit in cash.
RECEIPT OF CELLULAR TELEPHONE
AND ACCESSORIES: Renter
acknowledges receipt of the
cellular telephone and charger
in good working condition.
Renter agrees to return the
cellular telephone and
accessories in good working
condition, less normal wear and
tear relative to the time the
cellular telephone is in the
possession of the Renter.
LOST OR STOLEN TELEPHONE: If the
cellular telephone is lost or
stolen, Renter agrees to
immediately notify CTR
immediately and Renter
acknowledges responsibility for
all charges incurred until the
loss is reported. If the
cellular telephone is lost,
stolen, damaged beyond repair or
the Renter fails to return the
cellular telephone, the Renter
authorizes the amount of One
Hundred Twenty-Fifty U.S.
dollars ($150USD) be retained by
CTR from the deposit as
liquidated damages.
LOST OR STOLEN ACCESSORIES:
If the cellular telephone is
returned without the charger or
the SIM Chip (GSM phones only),
the Renter authorizes the amount
of twenty-five U.S. dollars
($25USD) be retained by CTR from
the equipment deposit as
liquidated damages. If the
cellular telephone is returned
without the protective case, the
Renter authorizes the amount of
ten U.S. dollars ($10USD) be
retained by CTR from the
equipment deposit as liquidated
damages. Such charges shall be
in addition to the rental,
International and/or Personal
Assistant call charges.
CELLULAR TELEPHONE SYSTEM
DISCLAIMER: Renter understands
and agrees that the cellular
telephone provided by CTR uses
the cellular telephone network
provided by the Instituto
Costarricense de Electricidad
(ICE) and that due to technical
limitations, terrain, weather
conditions and building density,
no representations and/or
guarantees have or can be made
that the cellular telephone
network and/or the cellular
telephone will operate
satisfactorily in every possible
location.
LEGALLY BINDING CONTRACT: This
contract has been translated for
the convenience of the Renter.
Terms shown in the original
Spanish version of this contract
are legally binding. A copy of
the original Spanish version of
the contract is available upon
request.
